By using the Services, you agree to the collection and use of information in accordance with this Policy. If you do not agree, please do not use the Services.
If you reside in the EEA/UK or another region with data protection laws, The Holmes Company of New York LLC is the controller of your personal data unless stated otherwise.
2) What we collect
The information we collect depends on how you use the Services. We collect:
A. Information you provide directly
Account and profile data: phone number or email (for login), display name, username/handle, avatar, bio, and other profile fields you choose to add.
Content you create: workout logs (exercises, sets/reps/weights, notes), goals, comments, likes, posts, images, and videos you upload.
Communications: messages you send to us (support requests, feedback) and your preferences (e.g., marketing opt-in).
Payment info: if you purchase a subscription or other offerings, we receive limited payment metadata from our payment processor (we do not store full card numbers).
Device and log data: IP address, device identifiers, OS and app version, language, crash reports/diagnostics, and performance metrics.
Push token: device token used to deliver push notifications.
Cookies/SDKs: cookies and mobile SDKs for authentication, preferences, analytics, and security.
C. Information from third parties
Authentication and messaging providers: e.g., phone/SMS verification or email delivery.
Payment processors: subscription status, transaction metadata (success/failure, last 4 of card, expiration month/year), but not full card details.
Analytics/measurement: aggregated performance and engagement data.
User content shared by others: if another user tags you, comments on your post, or shares your content.
Special categories (health/fitness): Jim lets you log workouts and related fitness information that you choose to provide. We treat this as sensitive and protect it accordingly. We do not collect medical records, diagnosis, or protected health information (PHI), and Jim is not a medical device or a substitute for professional advice. If you connect a health data source (e.g., Apple Health, Google Fit), we will only read/write the data categories you explicitly authorize and will use them solely to provide the requested features.
3) How we use information
Provide and improve the Services: create/manage accounts, deliver daily workouts, store workout logs, provide social/community features, personalize content, and ensure the app functions as intended.
Communicate with you: send transactional messages (e.g., login codes, receipts), service notifications (e.g., new day available), and—with your consent—marketing messages you can opt out of.
Analytics and personalization: understand feature usage, measure performance, fix bugs, and improve recommendations.
Safety and security: authenticate users, prevent fraud/abuse/spam, enforce terms and community guidelines, protect the integrity of the Services.
Legal/compliance: comply with law, respond to lawful requests, and defend legal claims.
4) Sharing and disclosure
We share personal information in these limited circumstances:
Service providers (processors): hosting and storage, analytics, messaging (SMS/push/email), customer support, payment processing, content delivery networks, logging/crash reporting. These providers may access your information only to perform services for us under contractual confidentiality and security obligations.
Other users / the public: content you choose to make public (e.g., posts, display name, avatar, likes/comments) is visible per your settings. Workout logs and stats may be shared if you choose to post them.
